Terms of use
1. Who we are
diaper.best is run by bytebrand.org – Matthias Neuhauser (see the imprint). These terms apply to the use of the website.
2. What diaper.best is
A comparison of adult diapers and pads: measured dimensions, capacities, fit by hip size, community ratings and prices from shops. We sell no diapers. If you buy one, your contract is with the shop or Amazon, under their terms. What we sell is access to our full price information (section 3).
3. Accounts and access to every listing
Every price is free to see. Shops that are not our partners are shown without their name and link unless you have access to every listing. An account is free; you sign in with a link we e-mail you.
Newsletter month. Subscribing to our newsletter gives your address one month of access, once. It ends when you unsubscribe.
Paid access. For 12 EUR a year (12 USD outside Europe), VAT included where it is due, you get access to our price information, i.e. digital content: every shop's name and link in every price table, for one year from your payment. It renews for another year at the same price unless you cancel the renewal before the renewal date, which you can do at any time on your account page; your access then runs until the end of the period you paid for. Free months you earn while paying move the renewal date later. Payments are processed by Stripe. Paid access is not offered in the United Kingdom.
No right of withdrawal once access starts. Access starts the moment you pay. Before paying, you expressly request immediate access and acknowledge that you thereby lose your right of withdrawal (§ 18 (1) Z 11 FAGG); we confirm this by e-mail. A paid period is therefore not refunded, also not when you cancel the renewal or delete your account. Your statutory warranty rights remain.
4. No medical advice
The information helps you compare products. It does not replace advice from a doctor, nurse or continence adviser.
5. Accuracy
We compile data with care from manufacturers, shops and our own measurements. Products change, though, and shops change prices and stock at any time. Prices and availability show the state of our last check. What the seller's page says when you order is what counts.
Insurance coverage. Where a product page or filter names a public scheme's list of covered products (such as a US state's Medicaid list or Germany's Hilfsmittelverzeichnis), we copied it from the list the scheme publishes, for your information only. It is no promise that your insurer, plan or supplier covers or supplies the product, and no advice on what you are entitled to: lists change, and insurers and suppliers decide. Ask your insurer or supplier. Like everything on this site, it comes without liability on our part (section 10).
6. How lists are ordered
No one pays for a position. By default, products are ordered by the number of shops we track that carry them. Every other order follows the figure it names: capacity, rating, fit for your hip size, price per litre. The price-per-litre order and the shop rows on product pages use every shop we track; shops that are not partners (shops that pay us a commission, and Amazon) are shown without their name unless you have access to every listing. 7. Affiliate links
Links to Amazon and to partner shops earn us a commission on purchases. It costs you nothing. When you click such a link, our server counts the click (see the privacy policy).
8. Fair use
You may use the site for your own information. Automated mass access (scraping, crawling beyond robots.txt) and copying the database are not allowed, with or without paid access. Requests above a fair rate are refused.
9. Rights
Our measurements, texts, charts and the compiled database are ours (copyright and database right). Product names, brands and pictures belong to their owners.
10. Liability
The site is provided as it is, without any warranty that its information is complete, correct or up to date. We are not liable for damage arising from the use of the site or from relying on its information, unless we caused it intentionally or through gross negligence. We are not responsible for the content of sites we link to; if we learn of unlawful content behind a link, we remove the link.
11. Changes
We may change these terms. The version on this page applies, with its date; for paid access, the version you agreed to at your payment applies until your next renewal.
12. Law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory protection of the country you live in remains.
